Regulated prediction exchange Kalshi hit a major legal roadblock today as a state judge granted an emergency injunction forcing the platform to suspend sports betting derivatives and non-financial event contracts.
In a major legal setback for prediction markets, a state court judge has issued an immediate preliminary injunction against exchange operator Kalshi, ordering the platform to cease offering sports-related contract betting and novelty wagering products within the state jurisdiction.
The legal challenge, brought forward by state gaming control boards, argues that Kalshi's rapid expansion into event contracts tied to athletic game outcomes and entertainment awards constitutes unlicensed sports gambling, violating state gaming regulations regardless of federal CFTC designation.
Federal CFTC Oversight vs. State Gaming Commissions
Kalshi had previously secured federal approval to list political and macroeconomic binary options. However, state regulators assert that derivative contracts structured on sports scores cross the line into traditional sportsbooks, which require individual state licenses, tax compliance, and consumer protection oversight.
"Federal commodity regulations do not grant prediction exchanges carte blanche to bypass state gambling statutes," the presiding judge wrote in the injunction ruling.
