Court Rules Kalshi Sports Betting Contracts Are Subject to State Gambling Laws

A federal court has dealt a major regulatory setback to prediction market platform Kalshi, ruling that event contracts linked to athletic games constitute sports gambling subject to state licensing requirements.

Kalshi had contended that its CFTC-regulated binary event contracts qualified as federally exempt financial swap instruments. The court rejected this classification, determining that sports outcome betting cannot bypass state gaming commission oversight.

The decision provides state gaming boards authority to enforce local licensing and tax rules against event derivative platforms operating within their jurisdictions.

The ruling creates regulatory friction for prediction markets seeking to launch financial derivatives tied to culture, entertainment, and sporting events.
